Akwa Ibom State: Court Freezes Ibom Icon Hotel’s Bank Accounts Over Non-payment Of Debt
An Uyo High Court has issued an Order freezing the bank accounts of Ibom Icon Hotel for failure to comply with the Court’s Judgement Order earlier issued by a court of competent jurisdiction in August, 2021.
In a Garnishee proceedings brought before Hon. Justice Theresa Obot of the High Court, Uyo, Paul Nyambi, Esq., Counsel for the Judgment creditor / Applicant urged the honourable Court to attach the Judgment debt of N7, 074, 363, 00 owed by the Defendants to the Judgement Creditor for supply of sundry items for the hotel since 2020.
Earlier in August, 2021, an Uyo High Court had ordered Ibom Icon Hotel to pay the Claimant Messrs Jeff and Dave Enterprise the sum of N7, 024,363.00.
In a case brought before the State High Court sitting in Uyo by Messrs Jeff and Dave Enterprises [Claimant] against Ibom Icon Hotel [Defendant ] for non-payment of outstanding debt for supply of goods since September and October 2020.
Delivering the judgement, the Honourable Justice Felicitas Ibanga held that after a careful consideration of the processes filed by the claimant’s and the Affidavit in support of the undefended list with Exhibits A to D, judgment was entered in favour of the claimant.
Legal cost of N50, 000 was also awarded against Ibom ICON Hotels
In an interview with the Counsel to the claimant, he said that every effort to get the Judgment debtor, Ibom ICON Hotel to pay the debt was completely ignored by the hotel.
The Claimant then proceeded to the Court under the undefended List to recover the debt.
All efforts to get the Defendant to comply with the Judgment Order proved abortive leaving his client with no other choice than to precede with the Garnishee proceedings towards enforcing the Judgment of the Court.
All efforts to reach the state commissioner for Tourism, Arts and Culture that has supervisory role over the property proved abortive; as well as the general manager of the hotel.
